Recently, the State Council decided to abolish the contents of the Food Quality Exemption Inspection System in the "Decision of the State Council on Several Issues Concerning Further Strengthening of Product Quality Work" (GF (1999) No. 24) issued on December 5, 1999. The General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China announced on September 18, 2008 that the Administrative Measures for Products Exempted from Quality Supervision and Inspection was abolished (Decree No. 9 of the General Administration of Quality Supervision, Inspection and Quarantine, 2001). In order to implement the spirit of the "Notice of the General Office of the State Council on the Abolition of the Exemption of Food Quality Inspection System", we hereby ban the use of "Exempt Inspection" in advertisements as follows:
The administrative departments for industry and commerce at all levels shall strengthen the monitoring and inspection of the contents of exempted inspections involving advertisements, and shall immediately order the suspension of publication of advertisements involving the content of exemption from inspections, such as "national inspection-free products". For those who continue to publish illegally, they shall be punished according to the relevant provisions of the "Advertising Law" and "Anti-Unfair Competition Law." If the advertisement of product packaging produced after the date of this announcement involves the content of quality exemption inspection, it shall be handled in accordance with the Notice of the General Administration of Administration on Relevant Issues Concerning the Supervision and Administration of Packaging Advertisements (ICBC [2005] No. 173).
