The China Consumers Association, in collaboration with the Liaoyang City Consumer Council in Liaoning Province, recently issued a consumer alert aimed at helping farmers better understand their rights when purchasing agricultural machinery. The warning highlights key time-based regulations under the "Three Guarantees" policy, which ensures consumers can seek repairs, replacements, or refunds within specific periods.
Under the 40-day rule, if a product breaks down during the "Three Guarantees" period, the repairer is required to fix the issue and ensure normal operation within 40 days from the date of repair. All repair records must be accurately documented, and if the product cannot be fixed, the seller must provide a free replacement of the same model and specifications.
For issues arising within 15 days of purchase, such as safety-related or performance failures, farmers have the right to request either a replacement or repair. The seller must comply with the farmer’s choice. Additionally, if an internal combustion engine, tractor, combine harvester, or agricultural transport vehicle is replaced within 15 days, the farmer may opt for a full refund, and the seller must process it free of charge.
For other types of agricultural equipment, if a failure occurs within 15 days after a replacement, the farmer can also request a return, and the seller must handle the return without charge.
Another important guideline involves the 5-day and 2-day rules. If a major machine like a combine harvester, tractor, or planter fails during the busy farming season, and the fault can be easily repaired through the service network, it should be resolved within two days. For more complex issues that cannot be fixed quickly, the seller has five days to resolve the problem. Outside of service centers, the seller is still responsible for repairs during the busy season and should agree on terms with the farmer at the time of sale.
These regulations are designed to protect farmers' interests and ensure they receive reliable support when using essential farm equipment. By understanding these timeframes, farmers can make more informed decisions and confidently seek assistance when needed.
