The China Consumers Association, in collaboration with the Liaoyang City Consumer Council in Liaoning Province, has recently issued a consumer warning aimed at helping farmers better understand their rights when purchasing agricultural machinery. The guidance focuses on key time-related regulations under the "Three Guarantees" policy, which ensures product quality and after-sales service for consumers.
Under the 40-day rule, if a product fails during the warranty period, the repairer is required to fix the issue and ensure normal operation within 40 days from the date of repair. All repair records must be accurately documented, and if the product continues to have problems, the seller is obligated to provide a free replacement of the same model and specifications.
There's also a 15-day regulation that applies when a product experiences a safety or performance issue within 15 days of purchase. In such cases, farmers have the right to choose between a repair or a replacement, and the seller must comply with their request. For certain heavy-duty machines like internal combustion engines, tractors, combine harvesters, and agricultural transport vehicles, if a replacement occurs within this 15-day window, farmers may also request a full refund, with the seller responsible for processing it free of charge.
For other types of products, if a failure or performance issue arises within 15 days after a replacement, farmers can still request a return, and the seller must facilitate the process without additional cost.
Additionally, there are specific rules for the busy farming season. If a machine such as a combine harvester, tractor, or planter fails during this critical time, any fault that can be easily repaired within the service network should be fixed within two days. If the problem cannot be resolved quickly, it must be addressed within five days. Outside of service centers, sellers are expected to assist with repairs during the busy season, and these responsibilities should be clearly communicated and agreed upon at the time of sale.
This updated guidance aims to empower farmers with clearer knowledge of their consumer rights and ensure they receive timely support when issues arise with their agricultural equipment.
